Office National Yatala Printing Terms and Conditions
Below are the standard printing Terms and Conditions (Terms) of Office National Yatala. These Terms apply to all individuals, businesses or companies (Client/s) engaging the services of Office National Yatala, its contractors, subcontractors and employees (ONY). All printing, design and/or specialty orders are subject to these Terms. By requesting printing, design or other services from ONY, the Client agrees to these Terms and Conditions and is aware they are entering into a binding contract - payment is required when due.
APPROVING PROOFS: A proof will be provided for all printing orders. The Client is responsible for approving all artwork proofs and to ensure that all content is correct and suitable including, but not limited to; spelling, grammar, layout, size, colours and job description. You will receive what you approve. Changes are not possible once printing has commenced, so it’s very important to check everything carefully prior to giving print approval. There will be no reprints at our expense. The Client accepts full liability for the final artwork content and job specications provided for approval. It is very important that you clearly confirm approval to proceed with printing in writing via reply email.
COLOURS: When viewing proofs, screen colours and desktop printer colours are often not consistent with printed colours and should be used as a guide only. Exact colour matching is not possible and a reasonable variation may be expected on separate print runs
PRODUCT PERFORMANCE: If a product is required for a specic purpose (eg. product must be weather-proof), this must be specied by the Client and included in the quotation. Any information relating to the lifespan of a product is an estimate only and may change depending on individual environmental conditions. No guarantees are given on the performance of materials supplied.
GRAPHIC DESIGN AND ALTERATIONS: All Graphic design work, including alterations, is done at a rate of $80.00 + GST per hour. Quotations for design work and alterations are estimates based on the work brief discussed prior to quoting. Quotations for alterations to existing artwork include 1 round of alterations only. Quotations for new artwork (eg. a new yer) include the initial design plus one round of minor alterations. ONY reserves the right to charge additional costs for ‘Excess Work’ if the Client requests further alterations or design work not mentioned in the original brief. Excess Work will be billed in 15 minute increments at the above hourly rate. The Client will be notied if the work exceeds that which is outlined in the original brief. To avoid additional costs, please ensure all content is approved before you send it to us, and all requirements are included in your initial brief. Providing adequate feedback on the rst proof (eg. making all changes at once) will save a lot of time moving forward.
SUPPLIED ARTWORK: Clients who choose to submit their own artwork, les and/or images are solely responsible for the end result of printing. ONY shall incur no liability whatsoever for errors or incorrect colours in supplied artwork, or problems with the nished product due to les not meeting our specications. It is the clients responsibility to ensure that the supplied artwork is print-ready and correct including size, colours, positioning, content and quality. Alteration of supplied les will be charged at standard hourly rates. Where artwork is supplied incorrectly, additional costs may apply for checking les. Please contact us for artwork requirements prior to supply. The Client is responsible for obtaining all necessary authorities and consents to reproduce any pictures, artwork, photographs, copyright text and/or any other reproducible materials prior to instructing ONY to reproduce the same, and the client accepts full liability for any copyright or other infringements.
OWNERSHIP: All artwork and products produced by ONY remain the sole property of Office National Yatala until paid for in full. Artwork may not be reproduced without the express written permission of ONY. We reserve the right to use images of the Client’s designs or printed products in our advertising and social media posts. Please advise us in writing if you wish to be excluded.
DELIVERY: Delivery includes one drop only unless otherwise stated on your quotation. Delivery will be made to the address we have on le. The Client must notify ONY in writing of any address changes at the time of placing an order. Free local delivery is subject to the delivery address.
TURNAROUND TIME: Turnaround time on printing orders begins once the deposit has been received (where applicable) and your final artwork is approved and ready to print. If artwork is not ready to print at the time of ordering, printing turnaround begins once the print-ready artwork is approved to print, not from when the order was rst placed. All turnaround times are based on business days, Monday to Friday, excluding public holidays. Turnaround time begins the following business day after print approval. Turnaround times provided are estimates only and are subject to change. Turnaround times are for production and exclude delivery time. Due to circumstances beyond our control ONY is unable to guarantee delivery dates, agreed or otherwise and shall incur no liability whatsoever for any order exceeding the estimated turnaround time for any reason. We do not provide refunds or accept cancellations due to changes in turnaround time.
PAYMENT & DEPOSITS: A deposit is required prior to any work commencing for non-account holding clients, and the deposit amount will be taken off the final invoice. Account clients will receive a tax invoice upon completion which is due for payment within 30 days of EOM. Should a project exceed 30 days, ONY reserves the right to invoice for work completed up until that point including graphic design, materials specially ordered and any other relevant costs.
QUOTATIONS: Quotations are valid for 30 days unless otherwise stated. If unspecied, graphic design and delivery charges may apply (where required). The specications quoted should be checked carefully to ensure all of your requirements have been included. Should stock or production costs change outside the control of ONY, the Client will be notied of any changes prior to printing and a new quotation provided for approval. E.&O.E.
CANCELLATIONS: In the event of cancellation or change of mind once a project has commenced, the Client agrees to pay for all costs incurred by their project up until that point. These costs may include time spent on graphic design, resources allocated, products used or printing completed to- date. If printing production has commenced, the order cannot be changed or cancelled and full payment will be required upon completion.
Specialty stocks cannot be changed or returned once ordered, and full payment for the stock will be required if the project does not proceed.
Due to the custom nature of printed items, there are no returns or refunds available on printing or graphic design orders.
RIGHT OF REFUSAL: ONY reserves the right to cancel an order or refuse taking on a project for any reason including, but not limited to; jobs it deems are obscene or offensive, indecent or improper material, any material that could give rise to any civil or criminal liability under applicable law; and any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons who are shown in the material if applicable. We will refuse an order, which in our opinion may be illegal in nature or an infringement on the rights of any third party. You accept full legal liability for the content of material processed and printed on your behalf and under your instructions. We reserve the right to refuse an order without disclosing a reason. ONY reserves the right to charge the Client for services rendered up to the point that the job was cancelled.
CLAIMS: Any claims on defective or incorrect products will not be recognised after 30 days of receipt of goods. ONY consistently maintains high levels of quality control, however, if you believe you have received faulty products please contact us immediately for review. Some products (eg. bags) contain natural or unavoidable variations that are not considered a fault. ONY may replace goods or offer a discount where it deems that a fault has occurred. If a replacement is offered, the faulty goods must be returned to ONY for investigation.
DISCLAIMER OF IMPLIED WARRANTIES: Office National Yatala warrants only that the work will conform to the descriptions contained in the original order approved by the client. Office National Yatala’s maximum liability, whether by negligence, contract or otherwise, will not exceed the return of the amount invoiced for the work in dispute. Under no circumstances will ONY be liable for specic, individual or consequential damages.
